The following provisions establish the general conditions of sale of the products offered by the company PLAYA-LOCA on its website at the following address: www.playa-loca.com (hereinafter referred to as "the Site". PLAYA-LOCA is a micro enterprise whose head office is located at 33 rue des violettes 50400 Granville and is registered in the Register of the Coutances Chamber of Trades under the number siret 43226511400020

The Site offers for sale costume jewelry items, fashion accessories, ready-to-wear and decorative items.

PLAYA-LOCA declines the responsibility for all direct or indirect damages, whatever the causes, origins or natures as well as consequences of all natures which could be caused by the possible fraudulent intrusion of a third party on this site , the impossibility of accessing it, its use, and the credit granted to any information coming directly or indirectly from this site.

Any order for a product offered on the Site implies consultation and express acceptance of these general conditions of sale and withdrawal, manifested by ticking the box "I have read the general conditions of sale and withdrawal and I fully subscribe to it. "

PLAYA-LOCA makes it impossible to sell products without having previously accepted without reservations, the clauses below.

ARTICLE 1.

SUBJECT: These conditions aim to define the terms of sale between PLAYA-LOCA and the customer, from the order to the services, including payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

They apply without restriction or reservation. PLAYA-LOCA reserves the right to modify them at any time and without notice. In this case, the applicable conditions will be those in force on the date of the order by the customer.

ARTICLE 2.

PRODUCTS: PLAYA-LOCA aims to offer for sale its own jewelry and other products, fashion accessories and decoration within the limits of available stocks. The products are those listed for sale on the day of consultation by the user. When the product is unavailable, it is displayed on the site, failing this, in the event of an error, PLAYA-LOCA undertakes to notify the customer by email as soon as possible. If the product has already been paid, PLAYA-LOCA agrees to reimburse the price of the item to the customer. The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, the responsibility of PLAYA-LOCA could not be engaged. The photographs and texts illustrating the products do not enter into the contractual field.

ARTICLE 3

 PRODUCTS: Prices are indicated in Euro including VAT. They take into account the French VAT, applicable on the day of the order. If the VAT rate were to be changed, these changes would be reflected in the price of the items. PLAYA-LOCA reserves the right to modify its prices at any time. However, these prices could not be modified once the order has been confirmed. The prices indicated do not take account of the shipping costs which will be added to the total of the order and will be specified to the customer during the final validation of his order.

The products remain the property of PLAYA-LOCA until full payment of the price.

The marketing and delivery of products is not limited to any territory. In the event of an order destined for a country other than mainland France, the customer is solely responsible for verifying the possibilities of importing the products ordered with regard to the law of the delivery territory as well as for the payment of any customs duties , taxes and other fees.

The products and services offered by PLAYA-LOCA are presented on the Site in French. Foreign-language customers therefore place their orders with full knowledge of the facts, and cannot claim their linguistic ignorance in any way whatsoever.

ARTICLE 4

ORDERS :

- REGISTRATION OF AN ORDER: The customer who places an order directly on the Site must follow the following procedure: Choose the different products (as well as the sizes if applicable) in which they are interested and click successively on the "Add to cart" link ". At any time he will have the possibility: Either to obtain a summary of the selected products by clicking on the link "My basket", or to continue his purchases. By clicking on "Order", the customer accepts the prices and the related payment obligation, the volumes, the description of the products and the quantities of products offered for sale and previously selected by clicking on "Add to cart". The customer will complete his order by clicking on "Order".

 The order can only be registered on the site if the customer has successfully created an account, as offered on the Site. The customer will be able to identify himself on the Site using his email address and password which are strictly personal to him.

The shipping costs are calculated according to the country of delivery, the weight, and are indicated to the customer before the validation of his order.

- VALIDATION OF THE ORDER: The order is effective when the customer has read and approved the general conditions of sale by clicking on the box "I have read the general conditions of sale and I adhere to it without reservation" provided for this purpose. Payments are made by Paypal, credit cards, transfer or check.

PLAYA-LOCA will acknowledge receipt of the order upon validation, and will receive an order form by email summarizing: the nature, quantity and price of the products retained by the customer, as well as the method of payment chosen, his contact details and the delivery address of the package.

ARTICLE 5

PAYMENT AND SECURITY OF TRANSACTIONS: The amount due by the customer is the amount in euros indicated during the order confirmation. The customer guarantees to PLAYA-LOCA that he has the necessary authorizations to use the payment method he has chosen when registering his order.

In order to ensure payment security, the Site uses pay plug ( for payment with credit cards) and Paypal's secure payment services. Payment will be made on the Site via Paypal or pay plug or by check or bank transfer. In any event, PLAYA-LOCA reserves the right to refuse any order or delivery for "a legitimate reason" and in particular in the event of a dispute relating to the payment of a previous order, to the refusal of bank authorization during payment in line, to the unavailability of the product, to an abusive request from the customer, to a presumption of impossibility for the customer to contract, to a manifest intention on the part of the customer to harm PLAYA-LOCA or even for any other reason than PLAYA-LOCA reserves the right to explain to its client. The responsibility of PLAYA-LOCA cannot then be engaged under this title.

When the order is validated, the payment request is routed in real time to the secure remote payment manager. The electronic payment manager issues an electronic certificate. 

ARTICLE 6

TRADES

For an exchange, you have 30 days from the date of receipt. You can make the exchange request for another size.

To do this, we invite you to go to your PLAYA-LOCA account and request a return for exchange.

If the size you selected is no longer available for exchange, we will refund your item.

The return for an exchange is customers's  responsibility .

RIGHT TO RETRACT

In accordance with article L. 221-18 of the consumer code, the customer has a period of thirty (30) clear days from receipt of the products, to withdraw and return, at his expense, the products orders.

The products must imperatively be returned to PLAYA-LOCA customer service at the address below, in perfect condition for resale (complete, undamaged, etc.), in their original condition (packaging, accessories, instructions. ..), and accompanied by the withdrawal form available on the Site.

After receipt and verification of returned products, PLAYA-LOCA undertakes to reimburse all of the sums paid by the customer for the acquisition of said products, including standard delivery costs, by the same means of payment as that used by the customer when ordering.

PLAYA-LOCA refunds

 said sums, without undue delay and at the latest within thirty (30) days from the date of dispatch of the product subject to the right of withdrawal (postmark or transport slip authentic) .

PLAYA-LOCA is not responsible in the event of failure of the means of transport services,

PLAYA-LOCA may nevertheless defer reimbursement until recovery of the goods.

The customer must follow the following different steps to return one or more products in the MY ACCOUNT / HISTORY AND DETAILS OF MY ORDERS section on the Site:

4. Print the repair slip available in the "MY RETURNS" tab

5. Drop the tracked letter in a post box or colissimo at La Poste

It is advisable to use a letter followed by 150 g to return up to two "PLAYA-LOCA" bracelets (one bracelet weighs approximately 60 g) or a letter followed by 300 g to return up to 5 bracelets. To return any other product, it is advisable to use a Colissimo envelope.

Return costs are the responsibility of the customer and any risk related to the return of products is the responsibility of the customer.

Parcels sent postage due are not accepted.

Once your return request has been processed by our services, you will receive an email with the change in the status of your order by "parcel received".

Consequently, PLAYA-LOCA proceeds to the reimbursement of said sums, without unjustified delay and at the latest within thirty (30) days from the date of dispatch of the product subject to the right of withdrawal (postmark or transport slip authentic).

Exception to the right of withdrawal

Pursuant to Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised in the presence of products "made to the specifications of the consumer".

GUARANTEES

PLAYA-LOCA, in application of article L. 217-15 of the consumer code relating to the commercial guarantee, allows the customer in the event of a problem concerning the conformity of the products delivered (error in preparation of order, damaged product, defect product quality etc ...), to send a complaint to the PLAYA-LOCA after-sales service at the following email address:

    celine.oliveira@playa-loca.com, within thirty (30) days of receiving the order.

The customer will take care during his complaint within the time limit, to detail the reason for his complaint and to specify the order number and the product (s) concerned.

Failure to comply with the procedure and deadlines set out above, the customer can no longer make any direct complaint to PLAYA-LOCA for non-conformity of the order or apparent defect in the products delivered, the products then being deemed to be in conformity and exempt of any vice.

If the error in the order or the defect is proven, the procedures for returning non-conforming products are indicated below.

The customer must follow the following different steps to return one or more products, in the MY ACCOUNT / MY ORDERS section on the Site:

Any risk related to the return of products is borne by the customer.

Are excluded from the commercial warranty, products modified, repaired etc ... by the customer. The commercial warranty will not cover returned products damaged during transport or due to improper use.

A product returned by the customer in accordance with the terms indicated by PLAYA-LOCA will give rise, depending on the case, to an exchange, a refund of the purchase price or a repair.

Lorsqu’il s’agit d’une réparation, les produits défectueux seront pris en charge au siège social de PLAYA-LOCA adresse à laquelle doivent être adressés les produits à réparer. Le traitement par PLAYA-LOCA (SAV) de la réparation d’un produit est d’environ deux semaines, hors délais d’expédition. 

Il est précisé qu’outre la garantie commerciale de PLAYA-LOCA prévue ci-dessus, cette dernière reste dans tous les cas, tenue de la garantie légale de conformité des articles L. 217-4 à L. 217-12 du code de la consommation, et de celle relative aux défauts de la chose vendue résultant des articles 1641 à 1648 et 2232 du Code Civil.

Les dispositions légales relatives à la garantie légale de conformité et aux défauts de la chose vendue sont exposées ci-dessous : 

L’article L. 217-4 du code de la consommation dispose :
 « Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité. »

L’article L. 217-5 du code de la consommation dispose :
« Le bien est conforme au contrat :
 S'il est propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant :
- s'il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l'acheteur sous forme d'échantillon ou de modèle ;
- s'il présente les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage ;
 Ou s'il présente les caractéristiques définies d'un commun accord par les parties ou est propre à tout usage spécial recherché par l'acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.»

L’article L. 217-12 du code de la consommation dispose :
« L'action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.»

L’article L. 217-16 du code de la consommation dispose :
« Lorsque l'acheteur demande au vendeur, pendant le cours de la garantie commerciale qui lui a été consentie lors de l'acquisition ou de la réparation d'un bien meuble, une remise en état couverte par la garantie, toute période d'immobilisation d'au moins sept jours vient s'ajouter à la durée de la garantie qui restait à courir.
Cette période court à compter de la demande d'intervention de l'acheteur ou de la mise à disposition pour réparation du bien en cause, si cette mise à disposition est postérieure à la demande d'intervention. »

L’article 1641 du Code Civil dispose :
« Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus. »

L’article 1648 alinéa 1 du Code Civil dispose :
« L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice. »

Il est expressément précisé que les clients ayant acheté un produit de la marque « PLAYA-LOCA ailleurs que sur le Site, notamment en boutique physique ou chez un autre revendeur internet, doivent contacter le revendeur où ils ont effectué leur achat ; PLAYA-LOCA n’en a nullement la responsabilité.

SERVICE APRES-VENTE – HORS GARANTIES

Lorsque le délai de garantie commerciale de 30 jours est expiré ou lorsque le client aura tenté de réparer lui-même son produit
, la réparation pourra être proposée au client par PLAYA-LOCA, moyennant une participation financière du client indiquée au préalable par devis et après acceptation du client du dit devis. Pour cela, écrire à l’adresse celine.oliveira@playa-loca.com.

Le retour de marchandises hors garantie devra être accompagné du règlement de la réparation (par chèque à l’ordre de Playa Loca).ARTICLE 7

INTELLECTUAL PROPERTY: All elements of the Site such as products, visuals, including the underlying technology covered by intellectual property rights, are protected and are the exclusive property of PLAYA-LOCA. Any fraudulent use will be prosecuted. The user who has a personal website and who wishes to place, for personal use, on his site a simple link direct to the PLAYA-LOCA site, must request prior authorization from PLAYA-LOCA. On the other hand, any hypertext link referring to the PLAYA-LOCA site and using in particular the technique of framing, deep-linking, in-line linking or any other deep link technique is in any case formally prohibited. In all cases, any link, even tacitly authorized, must be removed at the request of PLAYA-LOCA. Hypertext links may be sent to sites other than the Site. PLAYA-LOCA disclaims all liability in the event that the content of these sites contravenes the laws and regulations in force.

ARTICLE 8

DATA PROCESSING AND FREEDOMS: PLAYA-LOCA, for the needs of its activity, reserves the right to collect personal data relating to users of the site, in particular by means of "cookies". The consumer acknowledges having read it by consulting the Privacy Policy and the Cookie Information. Any customer of the site can at any time oppose the commercial use of said data and also has the right to access, rectify and delete data concerning him, directly on the Internet via the Contact us section.

ARTICLE 9

SIGNATURE AND PROOF: In accordance with the provisions of articles 1365 to 1367 of the Civil Code, resulting from the Ordinance n ° 2016-131 of February 10, 2016 in particular relating to the electronic signature, the online supply of the number of bank card and the final validation of the order constitutes an electronic signature and express acceptance of all the operations carried out on the Site between the parties.

This validation will be valid due of the sums engaged by the seizure of the articles appearing on the purchase order. In the event of fraudulent use of their bank card, the customer is invited, as soon as this use is observed, to contact PLAYA-LOCA customer service by sending an email to celine.oliveira@playa-loca.com. The computerized registers, stored in the computer systems of PLAYA-LOCA and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parties.

ARTICLE 10

CUSTOMS DUTIES: Any order placed on the Site and delivered outside the territory of mainland France, may be subject to possible taxes and customs duties imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the customer and are their sole responsibility. PLAYA-LOCA is not required to check and inform its customers of any applicable customs duties and taxes. To find out, it is up to the customer to inquire with the competent authorities of the country of delivery.

ARTICLE 11

ENTIRE AGREEMENT: These general conditions of sale and the order summary sent to the customer form a contractual whole and constitute the entire contractual relationship between the parties.

ARTICLE 12

DELIVERY :

The products are shipped with the delivery note, to the delivery address indicated by the customer when ordering, by letter followed or Colissimo within 3 to 5 working days, shipping costs are free from 30 € purchase. All orders validated before 9 a.m. are generally processed by PLAYA-LOCA within 24 hours.

The delivery times indicated when ordering are nevertheless indicative times, starting to run from the day following that of the validation by the customer of his order, and correspond to the times of processing and delivery (routing of products by post ) in working days.

In no case will the deadlines indicated be enforceable or incur any responsibility of PLAYA-LOCA. In the event of an unusual delay, however, an email may be sent to the customer by PLAYA-LOCA explaining the reasons for the delay.

Nevertheless PLAYA-LOCA in all cases undertakes to ensure delivery within a maximum period of thirty (30) days from the day following the purchase, subject to full payment of the price, in accordance with the provisions of article L 216-1 of the consumer code.

In the absence of the customer, the postman leaves a notice, indicating the conditions of withdrawal of the colissimo (place and time). It is possible to follow the progress of the package on the website www.coliposte.net.

In the event of non-receipt of the parcel followed up after 10 working days, without any notice of passage indicated, it is recommended to check its situation on the site www.coliposte.net and / or to contact PLAYA-LOCA customer service by email to celine .oliveira @ playa-loca.com.

PLAYA-LOCA will be under no obligation in the event of incorrect or missing mention in the delivery address or in the identity of the customer when entering the order made by the latter.

PLAYA-LOCA cannot be held responsible for delays in delivery due to La Poste or any other carrier. The risks of transport are borne by the customer, who must, if necessary, formulate a reasoned protest with the postal services or with the carrier, following the unjustified delay noted.

PLAYA-LOCA declines any responsibility, in case of loss or theft of the ordered products, strike, or any fortuitous event or force majeure.

In the event of delivery of an open and / or damaged package (cardboard box with visible traces of opening and / or deterioration), the customer is required to refuse the package to the Post Office or any other carrier.

If the customer has not had the opportunity to refuse the package upon delivery of the open and / or damaged package (case of non-delivery to person only) as well as in case of any missing products during the delivery of the order, it must imperatively notify its related claim within 3 working days of receipt of the order to the PLAYA-LOCA after-sales service by writing to celine.oliveira@playa-loca.com.

  

Any complaint concerning a missing product or an opened and / or damaged package made after this period will be rejected, and PLAYA-LOCA will be released from all responsibility.

ARTICLE 13

DISPUTES / APPLICABLE LAW

  The language of these general conditions of sale is French. This contract is subject to French law. And in the event of a dispute relating to an order and / or to these general conditions of sale, the French courts will have sole jurisdiction.
